2.2 General Booking Conditions
2.2.1 Pricing
2.2.1.1 Lotus of India endeavors to honor the tour price confirmed at the time of booking. However, prices may be subject to revision in the event of circumstances beyond our reasonable control, including but not limited to changes in government taxes or levies, the introduction of new taxes or regulatory charges, revisions to airline fares or airport taxes, fuel surcharges, currency fluctuations, supplier-imposed increases, modifications requested by the Traveler, waitlisted accommodations, or any other unforeseen circumstances. Any additional costs arising from such changes shall be borne by the Traveler.
2.2.2 Inclusions and Exclusions
2.2.2.1 The inclusions and exclusions applicable to each journey vary according to the itinerary selected. Travelers should refer to the detailed quotation or pricing proposal provided by Lotus of India for a comprehensive list of services included and excluded.

In such circumstances, Lotus of India reserves the right to amend the itinerary, alter the sequence of visits, or substitute services where reasonably necessary to ensure the continuity and safety of the journey.
2.2.3.2 Wherever reasonably practicable, Lotus of India will notify Travelers of any significant itinerary changes prior to departure. 2.2.5.1 By confirming a booking with Lotus of India, Travelers acknowledge and agree that certain travel services may be provided by independent third-party service providers, including but not limited to hotels, airlines, transport operators, guides, activity providers, and other local partners. While Lotus of India exercises reasonable care in selecting reputable and reliable service providers, it does not own, manage, or operate these third-party services and therefore is not the direct provider of such services.
Third-party service providers may establish their own terms, conditions, operating procedures, and safety guidelines. Travelers are solely responsible for complying with all such requirements. Any loss, damage, liability, or expense arising from a Traveler’s failure to comply with these guidelines shall remain the sole responsibility of the Traveler.
2.2.5.2 Travelers acknowledge that Lotus of India, including its owners, directors, employees, representatives, and affiliates, shall not be liable for any negligent, wrongful, or intentional act or omission by any independent third-party service provider. This includes, but is not limited to, airlines, rail operators, private transportation providers, motorcoach companies, vehicle rental companies, hotels, restaurants, cruise operators, boat operators, sightseeing operators, local guides, destination management companies, ground handlers, and adventure or outdoor activity providers.
Any claims arising from the services provided by such independent third parties shall be pursued directly against the respective service provider. Travelers expressly agree not to hold Lotus of India responsible for any act, omission, negligence, delay, or default on the part of any third-party supplier.
2.2.5.3 Lotus of India shall not be held liable for any additional expenses, losses, damages, or inconvenience arising from the delay, cancellation, disruption, or missed connection of any international or domestic flight, train, or other mode of transportation where such circumstances are beyond the reasonable control of Lotus of India.
Where reasonably practicable, Lotus of India will make every effort to assist Travelers in securing suitable alternative travel arrangements. Any additional costs associated with such revised arrangements shall be borne by the Traveler.
Should no suitable alternative be available, any applicable refund will be processed in accordance with the cancellation policies of the respective supplier, after deducting any applicable cancellation fees, administrative charges, or service fees.
Furthermore, Lotus of India accepts no responsibility for baggage, personal belongings, or valuables that are delayed, damaged, lost, or destroyed while in the custody of an airline, railway authority, or any other transportation provider. Any claims relating to such losses must be made directly with the relevant carrier or service provider.
2.2.6 Ground Transportation
2.2.6.1 Lotus of India will arrange ground transportation, including private cars, vans, coaches, or other vehicles, as specified in the confirmed itinerary. Vehicles are allocated based on the number of Travelers and the standard luggage allowance applicable to each vehicle category.
Should a Traveler carry luggage or personal belongings that exceed the standard vehicle capacity, Lotus of India reserves the right to arrange an additional vehicle or luggage transport service. Any resulting costs shall be the sole responsibility of the Traveler.
2.2.7 Airfares
2.2.7.1 Unless expressly stated otherwise in the confirmed quotation or itinerary, international airfare is not included in the tour price.
All quoted airfares, whether domestic or international, are subject to availability and may change until tickets have been issued. Airline or railway tickets will only be issued upon receipt of full payment of the applicable fare.
Airline tickets are subject to the fare rules, terms, and conditions established by the respective carriers, including but not limited to baggage allowances, ticket validity, cancellation policies, and fare restrictions. Tickets are generally non-transferable unless otherwise permitted by the issuing carrier.
Travelers are solely responsible for ensuring they possess all required travel documentation, including but not limited to a valid passport, visas, boarding passes, health documentation, and any other entry or transit requirements applicable to their journey.

Where applicable, Travelers must obtain a valid visa and any other required travel authorizations for entry into India and neighboring destinations, including but not limited to Nepal, Bhutan, and Sri Lanka, irrespective of the mode of travel, whether by air, land, or sea.
2.2.8.2 Obtaining and maintaining a valid passport, visa, entry permits, transit visas, health certificates, and any other required travel documentation is the sole responsibility of the Traveler, regardless of nationality.
Lotus of India strongly recommends that Travelers consult the relevant embassies, consulates, immigration authorities, or authorized visa service providers in their country of residence well in advance of departure, as entry requirements, immigration regulations, and travel advisories are subject to change without prior notice.
2.2.8.3 No refunds shall be provided for any unused services if a Traveler is denied boarding, refused entry, or otherwise prevented from commencing or continuing their journey due to reasons including, but not limited to, the absence of valid travel documentation, visa-related issues, passport deficiencies, failure to satisfy immigration or customs requirements, quarantine or isolation requirements, medical or public health restrictions, airline cancellations, vaccination or inoculation requirements, or any other directives imposed by government or regulatory authorities.
2.2.9 Behavior and Conduct
2.2.9.1 Travelers are required to comply with all reasonable instructions and decisions issued by the designated Tour Leader, Tour Manager, local guide, or any representative appointed by Lotus of India throughout the duration of the journey.
The Tour Leader reserves the right to suspend or terminate the participation of any Traveler whose conduct is unlawful, abusive, disruptive, unsafe, or otherwise likely to endanger the health, safety, comfort, or enjoyment of other Travelers, staff members, or service providers. This includes, but is not limited to, Travelers who become seriously ill, display symptoms of a contagious illness, are required to isolate or quarantine, or fail to comply with applicable health protocols, government regulations, or the rules established by accommodation providers, attractions, transportation operators, or local authorities.
Any removal or suspension under this clause shall not give rise to any liability on the part of Lotus of India, nor shall the Traveler be entitled to any refund, compensation, or reimbursement for any unused services resulting from such action.
Furthermore, Lotus of India shall not be responsible for any loss, damage, injury, expense, or claim arising directly or indirectly from a Traveler’s conduct.
2.2.9.2 Travelers are expected to conduct themselves respectfully and responsibly throughout their journey. This includes observing all applicable laws and regulations, respecting local customs, traditions, religious practices, cultural sensitivities, and the environment in every destination visited.
2.2.9.3 Travelers are solely responsible for the care and security of their personal belongings, including but not limited to luggage, passports, travel documents, cash, jewelry, electronic devices, valuables, and personal effects.
While representatives of Lotus of India and local guides may provide practical advice regarding personal safety and security, Lotus of India accepts no responsibility or liability for loss, theft, damage, or misplacement of personal belongings, including incidents arising from pickpocketing, theft, or negligence by third parties.
2.2.9.4 Travelers shall not engage in any unlawful, offensive, or inappropriate conduct, nor transmit, distribute, or possess any material that may constitute a criminal offence or give rise to civil liability.
Under no circumstances shall Lotus of India be liable for any consequences arising from a Traveler’s conduct, including any resulting losses, damages, legal proceedings, penalties, or claims.

2.2.10.4 Authorization for Medical Assistance
In the event of illness, injury, or medical emergency during the journey, the Traveler authorizes Lotus of India, its representatives, and local service providers to arrange or facilitate appropriate medical treatment or emergency assistance where reasonably necessary.
Any medical expenses, evacuation costs, hospital charges, or related expenses shall remain the sole responsibility of the Traveler unless covered by the Traveler’s personal insurance policy.
2.2.10.5 Health Restrictions and Special Requirements
Where a Traveler has allergies, dietary restrictions, physical limitations, medical conditions, or other special requirements that may affect participation in the itinerary, the Traveler must notify Lotus of India in writing prior to travel and provide complete details regarding any necessary accommodations or precautions.
While Lotus of India will make reasonable efforts to communicate such information to hotels, restaurants, transportation providers, and activity operators, it cannot guarantee that all special requirements can be accommodated.
Travelers remain solely responsible for carrying all required medications, medical devices, emergency treatments, and informing relevant service providers of any allergies or medical conditions before participating in activities.

2.2.10.9 COVID-19 Liability Disclaimer
Lotus of India shall not be held liable for any Traveler contracting COVID-19 or any other communicable disease, being subject to quarantine, isolation, travel restrictions, denied boarding, mandatory testing, or any resulting consequences occurring before, during, or after the journey. This provision also applies to minors and individuals travelling under the care of others.
No refunds, compensation, or reimbursement shall be payable for any unused services resulting from such circumstances.
3.1 Deposits and Final Payment
A non-refundable deposit equal to 25% of the total land arrangement cost plus the full cost of any domestic airfare is required at the time of confirmation for all tailor-made itineraries and special bookings.
The remaining balance must be received by Lotus of India no later than 60 days prior to arrival, unless otherwise specified. For travel during peak periods—including, but not limited to, Christmas, New Year, major festivals, or other high-demand seasons—full payment may be required 60 to 90 days prior to arrival, depending on the payment policies of hotels and other service providers.

4.5 Early Departure or Unused Services
No refunds, credits, or adjustments shall be provided where a Traveler joins the tour after its commencement, voluntarily leaves the journey before its completion, or is unable to utilize any portion of the itinerary due to personal circumstances, including but not limited to illness, injury, family emergencies, travel disruptions, or any other reason.
